Overview

This website is operated by Bechelet Design Group trading as HAVOLKA. Throughout this site the terms "we", "us" and "our" refer to HAVOLKA.

This website is a specification and information resource. It is not an online store. You cannot place an order or make a purchase through this site. HAVOLKA supplies through appointed distributors and stockists, who are responsible for pricing, sale, delivery and after sales service.

By accessing or using any part of this site you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the site.

We may update, change or replace any part of these terms by posting the revised version on this page. It is your responsibility to check this page from time to time. Continued use of the site after changes are posted constitutes acceptance of those changes.

1. Purchasing and pricing

No sale is made through this website. Product pages may display an indicative recommended retail price in Australian dollars including GST. This is published as a budgeting guide only. It is not an offer to sell, is not binding on us or on any distributor, and may differ from the price you are actually charged.

Pricing, availability, freight, payment terms and lead times are set independently by each distributor or stockist. Any contract of sale is formed between you and that distributor or stockist, not with HAVOLKA.

2. Product information and accuracy

We make every effort to describe our products accurately, including dimensions, materials, finishes and function. Product information, drawings and documentation are provided for general guidance and should be verified against the physical product and the requirements of your project before you rely on them.

Finishes are shown on screen and in photography. Screen rendering, lighting and manufacturing tolerance mean that on screen colour will not exactly match the finished product. Where finish is critical, view a physical sample or a display board at a distributor showroom before specifying.

We reserve the right to correct errors, change product specifications, and add or discontinue products at any time without notice.

3. Specification and door scheduling services

We may prepare door schedules, hardware schedules, specification text, drawings or other documentation at your request. These services are provided free of charge and without obligation.

Any schedule, specification or recommendation we provide is prepared on the basis of the information supplied to us, including plans, drawings and door types. It is provided as an aid to specification only. It is your responsibility, and the responsibility of the relevant designer, architect, builder or installer, to verify quantities, door types, handing, fire and compliance requirements, and suitability for the application before ordering or installing.

We are not acting as architect, building surveyor, certifier or engineer, and nothing we provide should be treated as professional advice in those fields. We do not accept liability for loss arising from reliance on a schedule or specification that has not been independently verified.

4. Compliance and suitability

Products must be selected, installed and maintained in accordance with our documentation and with all applicable Australian Standards, the National Construction Code and any relevant local requirements.

Not all products in the range are suitable for every application. Fire rated, accessibility, wet area, coastal and commercial applications each carry specific requirements. If you are unsure whether a product is suitable, contact us or your distributor before specifying or installing.

5. Downloads and technical files

Specification sheets, installation guides, drill templates, CAD files, BIM families and 3D models are provided for use in documenting and installing HAVOLKA products.

These files remain our property. You may use, copy and share them for the purpose of specifying, documenting or installing HAVOLKA hardware. You may not modify them to misrepresent our products, use them to specify or manufacture competing products, or present them as your own work.

Drawings and models are representations and may not reflect the current production item in every detail. Confirm critical dimensions against the physical product.

6. Intellectual property

All content on this site, including text, photography, product designs, drawings, product names, the HAVOLKA name and logo, and the arrangement of the site itself, is owned by or licensed to us and is protected by Australian and international intellectual property law.

You may not reproduce, republish, sell, or exploit any part of this site for commercial purposes without our written permission, other than as permitted in section 5.

7. Distributors and stockists

Distributors and stockists listed on this site are independent businesses. They are not our agents, employees or partners, and they have no authority to make representations, give warranties or enter into commitments on our behalf.

We are not responsible for the acts, omissions, pricing, terms, service or conduct of any distributor or stockist. Any dispute arising from a purchase should be raised with the business you purchased from.

8. Enquiries and information you send us

When you send an enquiry, subscribe to updates, or send us plans and project information, you consent to us using that information to respond to you, prepare schedules and documentation, and contact you about your enquiry.

We may share your enquiry and relevant project details with the distributor for your region so they can quote and supply. Your submission of personal information is governed by our Privacy Policy, available at https://www.havolka.com/policies/privacy-policy.

Do not send us confidential or commercially sensitive material unless we have agreed in writing to receive it. Where you send us plans or drawings, you confirm you are entitled to share them with us for this purpose.

9. Third party links

This site contains links to websites operated by third parties, including our distributors. We do not control those sites and are not responsible for their content, accuracy, privacy practices or terms. Inclusion of a link is not an endorsement.

10. Warranty

HAVOLKA hardware carries a 15 year warranty covering mechanical function, manufacturing defects and finish, in residential applications under normal use and correct installation.

Warranty terms, exclusions and the claims process are set out in our Refund Policy. Warranty claims are made through the distributor or stockist you purchased from.

11. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law.

12. Disclaimer and limitation of liability

To the extent permitted by law, and subject to section 11, this site and its content are provided on an "as is" basis without warranties of any kind. We do not warrant that the site will be uninterrupted, error free or secure.

To the extent permitted by law, and subject to section 11, we are not liable for any indirect, incidental, special or consequential loss, including loss of profit, loss of contract, project delay or rectification cost, arising from your use of this site, our documentation, or any schedule or specification we provide.

Where our liability cannot be excluded, it is limited at our option to resupplying the relevant goods or documentation, or paying the cost of having them resupplied.

13. Acceptable use

You may not use this site for any unlawful purpose, to infringe our rights or those of others, to introduce malicious code, to scrape or harvest data, or to interfere with the operation or security of the site.

14. Severability and entire agreement

If any provision of these terms is found to be unlawful or unenforceable, that provision is severed and the remaining provisions continue in force.

These terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and us in relation to your use of this site.

15. Governing law

These terms are governed by the laws of Western Australia. You submit to the non exclusive jurisdiction of the courts of Western Australia.
